    This link below to a Wired article raises interesting ethical issues which are beginning to appear in our world of analytics. With the advent of smart devices and the ability to remotely control them, comes along questions of who can control them, how can they control them and should these controls be regulated? I asked one of my goto people for ethics issues and he said while the issue of controlling customer thermostats does raise ethical issues, since it was not a compliance issue he did not want to comment. What do you think? As we progress into greater levels of analytics these questions will be more frequent. How intrusive can a utility be?  What’s your thoughts?

    Good topic!  I would think that if customers sign up for an energy efficiency program that allows the utility to adjust thermostats, it is ethical to do so, within the limits set in the program.  I have also seen agriculture irrigation pumps controlled by utility demand side management programs.  It is assumed that the customers know the impact of the adjustments they agree to, and have made the decision to participate based upon the benefits of the program.  If customers find that the modifications are happening too often, or the impacts are too disagreeable they can choose to stop participating.  In Texas, especially, demand management is an important tool for the system operators to use to manage times when reserves are tight, so finding the right balance between what is acceptable to the customer and what is useful for the utility, is such an important topic.

    Hello All,

    In the example provided I feel it is ethical because it is voluntary and one can opt out at any time.  We’ve got the “On Call” program which is similar and it gives a monthly credit whether or not the action is actually invoked.  Looking beyond thermostats I think there could definitely be other ethical issues with IoT devices out there.

    This is a really interesting topic. 

    It’s important to consider when these sorts of adjustments are likely to take place.  (in the article) The consumers thermostat is adjusted to a temperature that’s 4 degrees higher at the hottest times of the day, because that’s likely when the load on the system is the greatest.  But during that time, isn’t the consumer the most vulnerable?  People may actually need there cooling devices the most during these times of day, and expect those devices to work harder at those times.  So, it can appear that the “big bad” utility is taking advantage of the meek little consumer at their most vulnerable time by offering them a very unappealing choice: (i) either they can pay much more money for their power, or (ii) they can choose to be uncomfortable, and maybe even risk their health.

    Furthermore, this kind of arrangement can also be seen as a “penalty” for being poor.  It’s not hard to argue that someone who is financially limited, will be much more likely to “opt-in” to this sort of agreement, because it would allow for a lower cost immediately.  While someone who has more ample financial resources might be more likely to weigh the costs vs. the benefits of the arrangement before making the choice.

    From a legal perspective, at the heart of the matter is a statement that Melinda made, “It is assumed that the customers know the impact of the adjustments they agree to.”  This assumption requires that the consumer is “sophisticated” enough to understand the impacts assumed in the agreement.

    We are all familiar with the “Terms Of Use” documents that we are all asked to sign when accessing websites – how many of us have actually read them?  But, even if you have read the agreement, how many of us signed those agreements because we thought it was nearly impossible that any of those situations covered by those agreements would ever come to pass?
